Vortext Privacy Policy
Vortext is committed to protecting your privacy and adhering to the Privacy Act 1993. We strive to protect your personal information and will not use it for any purposes other than those outlined below without your consent. Violations of privacy are taken very seriously so please refer to the information below to find out about our policy and what to do if you think your privacy has been breached.
Scope
This policy refers to Vortext’s obligations and expectations with regards to privacy of personal and company information of our clients, i.e. those organisations that have applied for a user account for the purposes of creating mobile marketing campaigns.
User Information
The information you supply to Vortext on account application is private and will not be used for any purposes other than those outlined in this policy. We will not disclose information about you or your company to a third party unless we have your expressed consent or legally required to do so. When you register for an account with Vortext, you will be required to provide basic information about yourself and your company that Vortext will use to contact you to discuss options for the use of our services, and gather more information from you as needed. Only you and Vortext will have access to your account.
What Your Information is Used For
We use your information to identify you, contact you and keep track of your account activity. We may analyse information collected regarding your account activity to recommend ways that you can better utilise our services and generate beneficial results for your business. We may also use information obtained to enforce Vortext’s terms and conditions of use or to investigate complaints. Your information helps us with our own software and website develpoment so that we are providing you with products, services and information that is valuable and relevant to you and your business.
Account Protection
Only you and Vortext will have access to your account. Information and campaigns sent to and from Vortext sofware is the property of the account holder. Vortext takes no responsibility for the campaigns sent to account subscribers. Necessary measures will be taken to keep your account information safe through electronic means such as passwords, firewalls and encryption codes. Vortext adheres to the Privacy Act 1993 and the Unsolicited Electronic Messages Act 2007 and requires all users to abide by these Acts as well as our Privacy Policy and Terms and Conditions of use.
A Note About Protection of Subscribers’ (End Users) Personal Information
Vortext is also committed to protecting personal details of subscribers who opt-in to any of our clients’ campaigns. The electronic protections used to protect the organisation’s user account information are also in place to protect subscribers’ personal information. It is also the responsibility of the client to keep their subscriber lists and personal details of their subscribers private. Clients may not share or sell their subscribers’ names, phone numbers, or any other personal details they hold about them to any third party.
Account Alteration
You can change your account information at any stage by logging into your Vortext account online and changing any information you wish to. As per Vortext’s Anti-Spam Policy, users must give all subscribers the option to alter their subscription status and unsubscribe from their SMS campaigns. It is the responsibility of the client administering the campaign to acquire explicit permission from their subscribers to send them text messages, and must stop sending them messages as soon as they opt-out.
Limits to This Policy
Your privacy is extremely important to Vortext, however in certain circumstances your personal information may be disclosed to a third party if legally required to do so. As per the Privacy Act 1993, if another law is inconsistent with the Act, that other law will ‘trump’ the Privacy Act. Also, in special circumstances, the Privacy Commissioner can authorise Vortext to collect, use or disclose information even if it would breach one or more clauses of the Act.
Complaint Process
If you wish to make a complaint about a breach of your privacy, or any other aspect of our service, please contact us with as details of your complaint. A Vortext representative will respond as quickly as possible and we will endeavour to resolve your complaint in a timely manner.
Vortext have the right to change our privacy policy at any stage. Your continued use of your Vortext account after any changes will be deemed as acceptance of the changes. It is your responsibility to keep up to date with Vortext privacy policies and terms and conditions of use.
